Creator Terms of Use
PLEASE READ THESE TERMS CAREFULLY. THESE CREATOR TERMS OF USE ("CREATOR TERMS") FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU ("CREATOR", "YOU", OR "YOUR") AND ANTHUNT MARKETING LLP ("ANTHUNT", "WE", "US", OR "OUR"). THESE TERMS GOVERN YOUR PARTICIPATION IN CAMPAIGNS, COLLABORATIONS, AND SERVICES FACILITATED BY ANTHUNT FOR SOCIAL MEDIA AND CONTENT CREATORS UNDER OUR TALENT MANAGEMENT MODEL.
1. Eligibility Requirements
To participate in Anthunt's Talent Network or UGC Marketplace, you must:
- Be at least 18 years of age, or 13+ with verified parental consent
- Possess full control of your social media/content channels
- Be legally able to work and receive payments
- Not be under any exclusivity or agency agreement unless disclosed
2. Definitions
- Creator: An individual or group producing digital content or influence through social media, blogs, or video platforms
- Brand: A business client of Anthunt hiring creators for marketing campaigns
- Content: Any original or co-created material including video, image, text, or voice produced by a Creator
- Campaign: A structured marketing initiative by a Brand that involves creators through Anthunt's facilitation
- Talent Management: Strategic support by Anthunt to represent creators, manage deals, negotiate pricing, and streamline payments
3. Creator Onboarding & Account Setup
You must complete the registration process through our official channels or platform integrations. This may include:
- Sharing personal and tax information (for payment/legal purposes)
- Connecting social accounts via our authorized API tools
- Agreeing to onboarding forms or platform terms
- Completing a discovery call or vetting round (if required)
Failure to provide accurate or updated information may lead to termination of eligibility.
4. Representation Scope
Creators may enter into exclusive or non-exclusive representation agreements.
- Under exclusive agreements, Anthunt is your primary brand collaboration partner for the agreed term
- Under non-exclusive agreements, Anthunt may bring deals to you on a per-campaign basis, but you may accept external work
Exclusive representation terms, duration, and scope will be documented in a separate contract.
5. Campaign Participation Process
Once a brand selects you, Anthunt will:
- Share a campaign brief outlining deliverables, formats, deadlines, and compensation
- Provide creative guidelines and review rounds if applicable
- Coordinate posting times, hashtags, and disclosure requirements (e.g., #Ad, Paid Partnership)
- Collect performance data post-campaign
6. Creator Responsibilities
As a Creator, you agree to:
- Maintain authenticity of your social accounts
- Fulfill deliverables on time and in accordance with the brief
- Avoid using AI-generated or templated content unless pre-approved
- Not remove or hide sponsored posts within 30 days of publishing
Late or low-quality submissions may result in payment deductions or disqualification from future campaigns.
7. Payment Terms
Anthunt pays creators on behalf of brands under these conditions:
- Payments are made via bank transfer, Payoneer, or UPI within 30 days of campaign completion and brand approval
- You must submit all required deliverables (including insights/analytics) for payment release
- Anthunt is not liable for tax deductions unless required by law. Creators are responsible for managing their income tax or GST obligations
For large campaigns, a partial advance may be arranged depending on agreement.
8. Creator Rating and Eligibility
Each Creator may be scored internally on metrics like:
- Communication responsiveness
- Timely delivery
- Quality of content
- Campaign performance
Repeated low scores or negative feedback may result in removal from campaigns or delisting from the Talent Network.
9. Usage Rights and Content Ownership
Unless stated otherwise:
- You retain ownership of your original content
- Anthunt and the Brand may use, repost, share, amplify your content on social, digital ads, and email marketing with non-exclusive, royalty-free rights
- Any paid whitelisting, long-term licensing, or usage beyond 30 days will require separate approval or compensation
10. Whitelisting & Paid Media
If a brand or Anthunt wishes to use your content in ads or sponsored media, they must:
- Request your written consent
- Clearly define usage duration, platforms, and budget
- Compensate you accordingly (minimum usage fee to be discussed per campaign)
11. Confidentiality Agreement
You agree to keep all campaign information confidential, including:
- Creative briefs
- Pricing or negotiation terms
- Brand strategy or unreleased product info
This obligation remains valid for 5 years from the end of the campaign or creator relationship.
12. Communication Channels
You will receive all operational communication through:
- WhatsApp, Email, or Telegram
- Anthunt's platform (if integrated)
- Assigned Account Manager
You must confirm deliverables, briefs, and payment requests through official channels. Personal DMs or untracked messages will not be considered valid.
13. Content Restrictions
You agree not to submit or publish content that contains:
- Hate speech, nudity, violence, or political bias
- Intellectual property infringement
- Misleading medical or financial claims
- Misrepresentation of the brand
Anthunt reserves the right to request removal or revision of any content that violates platform guidelines or campaign terms.
14. Non-Disparagement Clause
You agree not to publicly defame, criticize, or spread false information about:
- Anthunt or its team
- Any associated brand or campaign
- Creators or collaborators on a project
Such actions will result in immediate removal from the Talent Network and potential legal action.
15. Social Media Behavior Clause
You must maintain ethical and professional behavior on all platforms. Anthunt may temporarily or permanently remove creators who:
- Engage in public online fights, defamation, or harassment
- Use fake followers, bots, or engagement tools
- Lose access to social accounts due to policy violations
16. Refunds and Deductions
In rare cases where a Creator fails to deliver or violates brief guidelines, Anthunt reserves the right to:
- Withhold full or partial payments
- Request refunds of advanced amounts
- Suspend or blacklist creator from future collaborations
17. Dispute Resolution
In the event of a conflict regarding campaign expectations, content rejection, or payments:
- Creators are encouraged to first contact info@anthunt.co
- If unresolved, mediation may be arranged
- Legal jurisdiction will be Ahmedabad, Gujarat, India
18. Termination of Agreement
Anthunt may terminate your participation at any time due to:
- Repeated non-performance
- Misconduct or breach of terms
- Brand request due to misalignment
You may request to be removed from the network by writing to info@anthunt.co. Ongoing campaigns must still be fulfilled or settled.
19. Data Use and Privacy
By working with Anthunt, you consent to:
- Sharing basic analytics and insights with brands
- Usage of your social handles and content for promotional purposes
- Receiving campaign updates and network news via email or WhatsApp
You may opt out of promotional emails anytime, but not essential project communication.
20. Legal Standing and Enforcement
These Creator Terms are governed by Indian law. In the event of legal interpretation, Anthunt's internal documentation (including WhatsApp chat confirmations and email trails) will be considered valid proof. Any clause deemed unenforceable does not affect the validity of the remaining clauses.
